1. Informational use only
The Site provides general information for planning recreational activities. All ratings, trail surface estimates, forecasts, alerts, drone conditions, astronomical information, maps and other content (together, the "Information") are generated automatically by software from publicly available third-party sources, including the National Weather Service, the NOAA Space Weather Prediction Center and CelesTrak, and from estimates and calculations based on that data. The Information is not produced, reviewed or verified by a person, is not a professional weather, safety, legal, aviation or land-management service, and is not advice of any kind.
2. Your responsibility and due diligence
You are solely responsible for your decisions and actions, and for the safety of yourself, your passengers, your companions, your vehicles and your equipment. Before and during any activity you must, at a minimum:
- obtain current, official weather forecasts and warnings directly from the National Weather Service or another authoritative source;
- confirm with the park, landowner or land manager that the area and trails are open, and comply with all permits, fees, closures, fire restrictions, vehicle requirements and rules;
- comply with all applicable laws and regulations, including vehicle, licensing and Federal Aviation Administration drone rules and airspace restrictions;
- personally observe actual conditions and use your own judgment, training and experience; and
- never rely on the Site as your only source of information, or for any emergency, safety-critical or life-safety purpose.
Conditions in the field can differ greatly from the Information. Weather changes rapidly, forecasts are often wrong, rainfall figures on the Site are estimates rather than measurements, locations are approximate, and data may be delayed, incomplete, missing or inaccurate. A favorable rating on the Site does not mean any activity is safe, legal or permitted.
3. Assumption of risk
Off-road driving and riding, camping, operating drones and related outdoor activities are inherently dangerous and can result in property damage, serious injury or death. Hazards include, without limitation, flash floods, lightning, extreme heat and cold, high winds, dust, wildfire, terrain, mechanical failure, and the actions of other people. You voluntarily and knowingly assume all risks of these activities, whether or not they are described on the Site, and whether or not you used the Site.
4. No warranties
THE SITE AND ALL INFORMATION ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITH ALL FAULTS AND WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTY OF ACCURACY, COMPLETENESS, TIMELINESS, RELIABILITY, AVAILABILITY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE OR NON-INFRINGEMENT. THE OWNER DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE OR ERROR-FREE, OR THAT ANY INFORMATION IS CORRECT OR CURRENT.
5. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, THE OWNER AND OPERATOR OF THE SITE, AND ITS AFFILIATES, CONTRACTORS AND SERVICE PROVIDERS (TOGETHER, THE "SITE PARTIES"), SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY PERSONAL INJURY, DEATH, PROPERTY DAMAGE, VEHICLE OR EQUIPMENT DAMAGE OR LOSS, FINES, PENALTIES, LOST PROFITS OR OTHER LOSS, ARISING OUT OF OR RELATING TO THE SITE, THE INFORMATION, YOUR RELIANCE ON IT, OR ANY ACTIVITY YOU UNDERTAKE, WHETHER BASED ON CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR ANY OTHER THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IF ANY SITE PARTY IS FOUND LIABLE NOTWITHSTANDING THE FOREGOING, ITS TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED ZERO U.S. DOLLARS ($0), OR, WHERE THAT IS NOT PERMITTED, TEN U.S. DOLLARS ($10). The Site is provided free of charge, and these limitations are an essential basis of that arrangement. Some jurisdictions do not allow certain exclusions or limitations, so some of the above may not apply to you; in that case, liability is limited to the smallest extent permitted by law.
6. Release
To the fullest extent permitted by law, you release and forever discharge the Site Parties from any and all claims, demands and damages of every kind, known or unknown, arising out of or relating to the Site, the Information or any activity you undertake.
7. Indemnification
You agree to defend, indemnify and hold harmless the Site Parties from and against any claims, liabilities, damages, losses, costs and expenses, including reasonable attorneys' fees, arising out of or relating to your use of the Site, your reliance on the Information, your activities, or your violation of these Terms or of any law or the rights of any third party.
8. Third-party data, links and advertising
Information is obtained from third-party public sources over which the Site has no control, and the Site is not affiliated with, endorsed by or acting on behalf of the National Weather Service, NOAA, CelesTrak, the Federal Aviation Administration, any land manager or any riding area listed. Links, maps and advertisements are provided for convenience only; the Site does not endorse and is not responsible for third-party websites, products, services or advertisers.
9. Acceptable use
You may not scrape, copy or redistribute the Site or its data endpoints in bulk, interfere with the Site's operation, or use the Site for any unlawful purpose. Access may be limited, suspended or discontinued at any time without notice.
10. General
These Terms are governed by the laws of the State of Indiana, United States, without regard to its conflict-of-law rules. Any dispute shall be brought exclusively in the state or federal courts located in Marion County, Indiana, and you consent to their jurisdiction. If any provision of these Terms is held unenforceable, it shall be enforced to the maximum extent permitted and the remaining provisions shall remain in full effect. Failure to enforce any provision is not a waiver. These Terms, together with the Privacy Policy, are the entire agreement between you and the Site regarding its use. The Site may change these Terms at any time by posting a new version; continued use after changes means you accept them.
